Raffaele Guariniello: vi dice niente questo nome? Per i distratti: è il magistrato che ha frugato negli armadi zeppi di scheletri della malaItalia più recente, dallo scandalo anni Settanta delle schedature Fiat (qualcosa come 354.077 cartelle su vita privata e orientamenti politici dei dipendenti), alla sicurezza sul posto di lavoro, al “processo Juventus” (per la somministrazione ai propri giocatori di farmaci proibiti), fino ai casi più recenti dei morti alla ThyssenKrupp, e delle vittime (a migliaia) della fabbrica di amianto (processo Eternit).
Come si può intuire, siamo in presenza di un p.m. che non insabbia, anzi di quelli tosti, perseveranti e scomodi. Non un supereroe, ma nemmeno un magistrato in cerca di consacrazione politica, piuttosto il “simbolo” - forse anche suo malgrado - della difesa dei diritti violati (oggi come ieri) a partire da quelli dei lavoratori, vessati per la loro scelta partitica, o costretti a giocarsi la salute in un’industria al veleno per garantirsi di che (sopra)vivere.
E’ da qualche mese in libreria con Donzelli un saggio che proprio dalle inchieste-boom di Guariniello prende le mosse, per esplorare alcune delle pagine più nere della storia italiana: il libro si intitola “Il giudice” ed è firmato dal giornalista de “La Stampa” Alberto Papuzzi. Ora non è per buttarla sempre e comunque in politica, ma in un Paese in cui le leggi sono ancora - spesso - “aggiustate” a beneficio dei più forti (dovesse sembrarvi grossa, in che mondo vivete?), l’approccio super partes alla giustizia di Raffaele Guariniello si rende necessario come il pane. Per farvi un’idea della tempra di cui è provvisto il giudice, andate a rileggervi le pagine dedicate all’interrogatorio del calciatore Fabrizio Ravanelli (pag. 67-73), poi quelle del processo ThyssenKrupp (Pag 103-128), quindi meditate sulla risposta che il p.m. medesimo fornisce a Papuzzi che, più o meno, gli chiede lumi sul senso del suo lavoro:
“Ho sempre avuto bisogno che le cose studiate diventassero cose concrete, in questo senso il mio studio non è mai solo teorico, è sempre pensato per come lo potrei utilizzare nei processi (…) Un ruolo attivo del magistrato nella ricerca delle notizie di reato presuppone uno studio, che può essere studio delle norme giuridiche ma anche dei presupposti scientifici, fino per esempio alla letteratura tecnica o a quella medica (…) Ci sono in particolare alcuni temi che m’interessano di più. Il primo è la sicurezza sui posti di lavoro. Quindi le questioni ambientali e la tutela del consumatore (…)”.
Un libro importante, che travalica il genere giurisprudenziale per approdare al saggio di storia e di inchiesta civile.
