Tutti CSI gli italiani e le italiane (crime scene investigator), tutti criminologi gli spettatori di talk show e trasmissioni televisive che sviscerano casi popolari di cronaca nera, tutti specialisti di profiling psicologici e tanatodiagnosi. Vista la passione per il genere, il consiglio che si può dare ai crime-dipendenti da salotto è di accrescere il bagaglio di conoscenze - sempre senza scomodarsi dal divano - aggiungendo al piccolo schermo una fonte di nozioni scientifico-pratiche come la Guida alla scena del crimine. Metodi e procedure. Si tratta di un manuale per futuri addetti ai lavori e allo stesso tempo per profani, realizzato una ventina d’anni fa dal britannico Ian K. Pepper e pubblicato in nuova edizione italiana l’estate scorsa, da Odoya di Città di Castello (giugno 2023, collana Odoya Library, numerose foto e illustrazioni in bianconero nel testo, 288 pagine), con testi di Carmelo Pecora e nella traduzione dall’inglese di Annarita Guarnieri.
Sulla qualità del lavoro depongono favorevolmente i biglietti da visita degli autori, che parlano di prestigiosi percorsi di formazione e di esperienze importanti. Pepper, titolare della cattedra di Policing nella Teesside University a Middlesbrough, nel North Yorkshire inglese, ha collaborato con le forze dell’ordine e la giustizia penale, insegnato scienza forense e scena del crimine, ideato corsi di formazione per investigatori e agenti di polizia in Estremo e Medio Oriente, Africa e Regno Unito. Carmelo Pecora, ex ispettore capo della Polizia scientifica della Questura di Forlì, scrive romanzi gialli dal 2017 e prima ancora testi di storia partigiana e su eventi criminali del recente passato (il caso Moro, la strage alla stazione di Bologna, Ustica, la Uno bianca).
Una nota di merito va ad Annarita Guarnieri, che si è sobbarcata l’impegno gravoso di rendere in un italiano comprensibile un elaborato in lingua originale non corrente, non parlata, ma strettamente scientifica, tecnica, professionale. Nella decennale esperienza di traduttrice editoriale ha vinto numerosi premi.
Il saggio del prof. Ian K. Pepper è sintonizzato sull’ordinamento giudiziario, criminologico, organizzativa del Regno Unito, ma i contenuti sono in gran parte generali e si estendono alla metodologia operativa in Italia.
L’ispettore capo supporta l’autore inglese con i suoi puntuali e agevoli interventi alla fine di ogni capitolo, aiutando a inquadrare l’assetto strutturale delle Polizie scientifiche italiane (i quattro RIS dei Carabinieri, Reparti Investigazioni Scientifiche a Roma, Parma, Messina, Cagliari, oltre al Servizio specializzato della Polizia di Stato, con i quattordici reparti interregionali e regionali della Scientifica).
Teniamo presenti innanzitutto, come ci invita a fare proprio Carmelo Pecora, i tre aspetti di base di un’analisi investigativa: cause dell’evento criminoso, scena del crimine, conoscenze e capacità degli investigatori impegnati. Ricorre all’esempio di un puzzle: indagare su un crimine è come unire i tasselli un po’ alla volta, a cominciare dagli elementi chiave rilevati sul luogo del delitto. Chi interviene di competenza sulla scena del crimine (CSI) ha solo quell’immediata opportunità di recuperare prove forensi sul posto: tracce di natura scientifica - dal DNA a segni particolari lasciati da un proiettile - o dettagli come fibre, capelli, peli, macchie di vernice e tutto il resto utile in loco. Se non si recuperano abbastanza prove, lo specialista forense non potrà identificare da dove e da chi provengano. Indubbiamente, il continuo progresso tecnologico offre nuovi strumenti inediti all’analisi investigativa, tanto di polizia quanto forense. Risorse che retro applicate a delitti precedenti irrisolti (cold case, casi freddi, quindi irrisolti) possono aiutare a fare chiarezza a distanza di tanti anni: il reato di omicidio non va mai in prescrizione.
Considerata l’importanza delle prove forensi nell’individuare e incriminare i presunti colpevoli, i CSI devono migliorarsi puntualmente, dato anche il gran numero di scene del crimine analizzate ogni giorno. Quella raccolta delle prove forensi diventa sempre più condizione pregiudiziale per risalire da un delitto a chi lo abbia commesso e per condurre l’imputato a processo, con prospettive più o meno fondate di arrivare ad una condanna.
Tornando alla sovraesposizione mediatica dei casi di cronaca nera e alla popolarità della stessa disciplina criminologica nel complesso, anche Pepper lamentava quanto la percezione comune del moderno investigatore fosse influenzata dalle fiction, che mostrano detective impegnati sulla scena del crimine a raccogliere prove in gruppo, senza indumenti protettivi, i maschi in giacca e cravatta, le donne in tailleur.
Questa raffigurazione distorta può andar bene in televisione, ma non riflette la realtà. Gli investigatori forensi lavorano spesso individualmente, consapevoli della necessità d’indossare un vestiario protettivo (guanti e tute sopra gli abiti) nel recuperare prove che uno scienziato forense esaminerà in un laboratorio specializzato.
I compiti di un CSI? Foto riprendere scena del crimine, vittime e proprietà; cercare-recuperare prove fisiche; individuare-rilevare impronte digitali; immagazzinare reperti per evitare contaminazioni; mantenere indici informativi sul modus operandi, i segni di scarpe, ecc.; fornire consigli su questioni scientifiche; preparare deposizioni e testimoniare in tribunale.
Non è scontato che tutte le prove vengono accolte in tribunale e concorrano a definire il giudizio delle Corti. In Inghilterra sono generalmente accettate.
Negli USA le prove stesse vengono sottoposte a un giudizio preliminare - devono rispondere a severi requisiti tecnico-scientifici - prima d’essere considerate affidabili e quindi ammissibili. In Italia, per semplificare, diremo che nel processo penale la Corte deve valutare le prove secondo il prudente apprezzamento, salvo che la legge disponga altrimenti. Sono quindi liberamente valutabili dal giudice, peritus peritorum perito dei periti, affidate al suo ponderato convincimento personale.
